Khayat Law Firm Secures Appellate Win in the Georgia Court of Appeals

Khayat Law Firm is proud to announce a successful appeal for its client in Birg v. Emory University, Case No. A26A0162.

On June 15, 2026, the Georgia Court of Appeals reversed an attorney’s fee award entered against the client under OCGA § 9-11-37. The Court held that the fee award was improper because the underlying motion for protective order had been withdrawn and never granted—a necessary condition for the award of fees under the statute.
